1. Introduction
These Terms and Conditions (the “Terms”) govern the relationship between WKRISHIND and the Author concerning the submission, acceptance, publication, and distribution of literary works.
2. Submission of Manuscripts
2.1. The Author must submit their manuscript electronically through the Publisher’s designated submission platform or via email or any media sharing chat platform.
2.2. The submission must be the Author’s original work and must not infringe upon the rights of any third party.
2.3. The Publisher reserves the right to reject any manuscript without providing reasons for the rejection.
3. Publication Rights
3.1. Upon acceptance of the manuscript, the Author grants the Publisher exclusive rights to publish, distribute, and sell the work in all formats, including print, digital, and audio.
3.2. The Publisher retains the right to license or sublicense these rights to third parties for translation, adaptation, or other purposes.
3.3. The Author retains the moral rights to their work but grants the Publisher the right to edit and modify the work as necessary for publication.
4. Author’s Responsibilities
4.1. The Author is responsible for ensuring that the manuscript is free from plagiarism and that all factual information is accurate.
4.2. The Author must cooperate with the Publisher in editing, revising, and promoting the work.
4.3. The Author must not submit the manuscript to other publishers or platforms without the written consent of the Publisher while under contract.
5. Royalties and Payments
5.1. The Publisher agrees to pay the Author royalties based on a percentage of the net sales of the work.
5.2. Royalties will be calculated and paid on an annual basis.
5.3. The Publisher shall provide the Author with a detailed statement of sales and royalties at each payment interval.
5.4. Any advance payments, if applicable, shall be recouped from the Author’s royalties before any further payments are made.
6. Marketing and Promotion
6.1. The Publisher will handle the marketing and promotion of the work at its discretion.
6.2. The Author agrees to participate in reasonable promotional activities, including interviews, book signings, and online promotions.
6.3. The Publisher retains the right to determine the cover design, pricing, and distribution channels for the work.
7. Copyright and Intellectual Property
7.1. The copyright of the work remains with the Author, subject to the rights granted to the Publisher under this agreement.
7.2. The Publisher shall include appropriate copyright notices in all published editions of the work.
7.3. The Author agrees to indemnify the Publisher against any claims or legal actions arising from the publication of the work, including but not limited to claims of copyright infringement or defamation.
8. Termination
8.1. Either party may terminate the agreement by providing 90 days written notice to the other party.
8.2. Upon termination, all rights granted to the Publisher under this agreement shall revert to the Author, except for any rights relating to existing inventory or ongoing contracts with third parties.
8.3. Any outstanding royalties owed to the Author shall be paid within 90 days of termination.
9. Confidentiality
9.1. Both parties agree to keep confidential any proprietary information received from the other party during the term of this agreement.
9.2. This confidentiality obligation shall survive the termination of this agreement.
10. Governing Law
10.1. These Terms and the relationship between the Author and the Publisher shall be governed by the laws of India, without regard to its conflict of law principles.
10.2. Any disputes arising out of or in connection with this agreement shall be resolved through [arbitration/mediation/litigation] in the courts of India.
11. Amendments
11.1. The Publisher reserves the right to amend these Terms at any time.
11.2. The Author will be notified of any changes, and continued submission of works or engagement with the Publisher will be deemed acceptance of the revised Terms.
12. Miscellaneous
12.1. This agreement constitutes the entire understanding between the Author and the Publisher and supersedes all prior agreements or understandings, whether written or oral.
12.2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12.3. The failure of either party to enforce any right under these Terms shall not be deemed a waiver of that right.
By submitting a manuscript to WKRISHIND, the Author agrees to be bound by these Terms and Conditions.
